First-Time Social Insurance Registration Procedures in Vietnam

Pursuant to Point a, Clause 1, Article 99 of the Law on Social Insurance 2014, employers must submit registration dossiers to the social insurance agency within 30 days from the date of signing a labor contract, work contract, or recruitment decision.

1. Application for first-time participation in social insurance

Pursuant to Article 23 of Decision No. 595/QD-BHXH, the required documents are as follows:

For employees:

  • Declaration of participation and adjustment of social insurance and health insurance information (Form TK1-TS);
  • If the employee is entitled to higher health insurance benefits: supporting documents (if any) in accordance with Appendix 03;
  • For foreign employees with additional labor contracts of a fixed term abroad, or labor contracts that have been extended, together with the documents evidencing the extension or any new labor contract signed in the receiving country under the contract.

For employers:

  • Declaration of the participating unit and adjustment of social insurance and health insurance information (Form TK3-TS);
  • List of employees participating in social insurance, health insurance, unemployment insurance, and insurance for occupational accidents and diseases (Form D02-TS);
  • Information summary statement (Form D01-TS).

Notes:

Form TK3-TS is used by an enterprise to register and obtain a unit code for its first-time participation in social insurance.

Form D02-TS is used to declare the list of employees eligible for social insurance (required).

Form TK1-TS applies to participants who have not yet been issued a social insurance number, or who need to update their personal information (with the household member appendix attached).

Form D01-TS is used to consolidate the supporting documents of the unit and participants as the basis for the collection of social insurance, health insurance, and unemployment insurance contributions (in cases where the unit reports a late increase of social insurance participants).

In addition to the above documents, enterprises must prepare the following materials to use as the basis for completing the forms:

  • Labor contracts
  • Household registration books and ID cards of employees

2. Procedure

Step 1: Prepare the necessary supporting documents in full, such as labor contracts, household registration books, and employee ID cards, to serve as the basis for completing the forms.

Step 2: If the unit has not yet been issued a social insurance participation unit code, it must submit Form TK3-TS to the social insurance agency to carry out subsequent procedures such as labor increase/decrease reporting and contribution dossiers.

The unit code will be issued within 1 to 7 working days.

Step 3: After the unit code is issued, prepare and complete the employee information on the corresponding forms in order to file the labor increase report.

Step 4: Submit the dossier to the social insurance agency.

Step 5: Once the complete dossier has been submitted, the social insurance agency will issue social insurance books and health insurance cards within no more than 5 working days from the date of receiving the full dossier.

3. Place of submission

Submit the dossier to the social insurance agency of the district where the enterprise is headquartered (based on the business registration license).

4. Submission methods

For paper dossiers:

Dossiers may be submitted through the postal service designated by the social insurance agency (free of charge). Enterprises only need to register an account and complete the required information; the postal service will then collect the dossier directly at the company.

For electronic submissions:

Submissions can be made through the social insurance declaration software of authorized I-VAN providers such as E-FY, BKAV, and others. The enterprise only needs a digital signature to complete the submission quickly and conveniently.
