NEW LABOR REGISTRATION FOR ENTERPRISES

1. . Legal grounds for the following administrative procedures:

• Section V Chapter XI of the Labor Code dated June 23, 1994; The Law amends and supplements a number of articles of the Labor Code dated April 2, 2002.
• Decree No. 34/2008/ND-CP dated March 25, 2008 of the Government on recruitment and management of foreigners working in Vietnam.
• Decision No. 54/2005/QD-BTC dated August 4, 2005 of the Ministry of Finance on the issuance of the fee for issuing work permits to foreigners working in Vietnam.
• Decision No. 1414/1997/QD-BLDTBXH dated November 17, 1997 on the authorization of a number of labor management tasks to the Management Board of industrial parks, export processing zones, hi-tech parks of provinces and centrally-affiliated cities.
• Circular No. 08/2008/TT-BLDTBXH dated June 10, 2008 of the Ministry of Labor, War Invalids and Social Affairs guiding the implementation of a number of articles of the Government's Decree No. 34/2008/ND-CP dated March 25, 2008 on recruitment and management of foreigners working in Vietnam.
• Official Letter No. 3713/LDTBXH-NN dated December 5, 2003 of the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City. HO CHI MINH CITY on the authorization of the Management Board of export processing and industrial zones in Ho Chi Minh City. HCM grants work permits to foreigners.
• Official Letter No. 2941/LDTBXH-NN dated August 5, 2004 of the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City. HCM on the authorization of the Management Board of export processing and industrial zones.

2. The order of implementation of labor registration and labor contracts is as follows:

• Step 1: Prepare a complete dossier of procedures as prescribed.
• Step 2: Apply at the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City.
  • In case the dossier is complete and valid, write an appointment slip for the applicant.
  • In case the dossier is incomplete or invalid, the applicant shall be instructed to complete the dossier.
• Step 3: Based on the appointment date on the receipt, the business representative goes to the Department of Labor, War Invalids and Social Affairs of Ho Chi Minh City to receive the settlement results.

3. Components of dossiers for labor registration and labor contracts include:

For foreigners recruited in the form of labor contracts:

• Written request for the issuance of work permits to foreigners (form No. 04).
• Application form (form No. 01). Judicial record cards issued by competent authorities of the country in which the foreigner resides before coming to Vietnam.

In case the foreigner has resided in Vietnam for a full 06 months or more, only a Vietnamese judicial record card is issued by the Vietnam Department of Justice where the foreigner is residing.

• Autobiographical resume (form No. 02).
• Health certificate.
• Certified copy of professional, high-tech qualifications (university, master, doctoral) or at least 5 years of experience in the profession, in production and management management.
• 03 color photos (size 3×4, bare head, face, face clarity, clear ears, no glasses, white font) photos taken no more than 06 months

For foreigners working in the form of internal business moves:

• Written request for the issuance of work permits to foreigners (form No. 04).
• Documents of foreign enterprises sending foreigners to work at the commercial presence of enterprises.
• Judicial record cards issued by competent authorities of the country in which the foreigner resides before coming to Vietnam.

In case the foreigner has resided in Vietnam for a full 06 months or more, only a Vietnamese judicial record card is issued by the Vietnam Department of Justice where the foreigner is residing.
